About these terms

These terms govern use of the website operated by Duncan for KC. They apply to the website’s information, forms, and interactive tools. Please use those features in accordance with these terms and applicable law. If you do not accept these terms, do not use the interactive features.

This is a political campaign website, not a government website or an official channel for city services. Our Privacy policy explains information handling. These terms do not create consent to optional campaign emails or to a new use of personal information.

02

Using the website

You are welcome to read, link to, discuss, and share the website for lawful purposes. You do not need an account to browse. Use accurate information when making a request, and provide someone else’s personal information only when you have permission or another lawful basis.

  • Do not impersonate another person or the campaign, submit fraudulent requests, or misrepresent an endorsement or affiliation.
  • Do not upload malicious code, attempt unauthorized access, evade security controls, or overwhelm the site with automated requests.
  • Do not use forms to send unlawful threats, spam, or information that violates another person’s privacy or rights.
  • Do not extract private submission records or use the site to obtain personal information you are not authorized to access.

These restrictions address misuse of the website. They do not prohibit lawful criticism, journalism, political discussion, or other protected expression.

Forms are not intended for children under 13. Older minors may need a parent or guardian’s involvement for participation. See the children’s information section of the Privacy policy.

03

Messages and participation

Submitting a form allows the campaign to receive and handle the information for the purpose of your request, subject to the Privacy policy. You remain responsible for the content you send. Do not submit passwords, payment card details, government identification numbers, medical records, or confidential information that the campaign does not need.

You retain any ownership rights you have in material you send. You give the campaign only the permission reasonably needed to receive, store, review, and respond to your submission. Sending a private message does not grant a blanket right to publish it, use your likeness, or present you as an endorser.

A form confirmation means a submission was saved. It does not confirm an email delivery, mailing-list enrollment, volunteer assignment, meeting, event, employment relationship, or other commitment. Participation details require a separate confirmation from the campaign.

04

Campaign email

Campaign email updates are optional and require the separate consent shown on the relevant form. Sending a question or expressing interest in volunteering does not automatically select that option.

You may withdraw your request for campaign email updates through an unsubscribe option in a campaign email, when available, or by contacting the campaign. A request about an existing submission may still need a response. These website terms do not enroll you in text messages or authorize automated calls.

05

Donations

Donation links lead to a separate payment website. Its checkout terms, privacy policy, payment rules, and any recurring-contribution authorization govern the transaction there. Read the contribution information and certifications before submitting payment. This website does not collect payment card details through its forms.

Contributions must meet applicable eligibility, source, amount, and reporting requirements. Do not contribute in another person’s name or give information you know to be false. The campaign may decline or return a contribution when required by law or otherwise appropriate.

Political contributions are not deductible as charitable contributions for federal income tax purposes. A contribution does not purchase goods, guarantee a policy outcome, or create a right to special access or services.

For a payment error, refund question, or change to a recurring contribution, use the options on your donation receipt or contact the campaign. These terms do not promise an automatic refund or replace any rights under applicable law. Required donor information may be included in public campaign finance reports.

06

Address and voter information

Address suggestions and district results are provided for convenience. They can be incomplete, outdated, or incorrect and do not establish voter registration, eligibility, a polling location, or an official district determination. Confirm voting information with the responsible election authority through the official voter resources linked on the homepage.

The address feature includes location suggestions and content from an outside mapping service. Use of that feature is subject to the address service terms and address service privacy policy, incorporated here for that feature. The address lookup privacy section explains what is transmitted and retained.

07

Campaign content and ownership

The site contains campaign text, artwork, photographs, logos, and other material owned by the campaign or used with permission or under a license. Third-party material remains subject to its own rights and license conditions. Nothing here gives the campaign ownership of another person’s work.

You may link to public pages and use built-in sharing features. Other reuse must be allowed by the relevant license, written permission, or applicable law, including fair use. Do not present altered material as an official campaign statement or use campaign marks in a way that falsely suggests sponsorship or endorsement.

If you believe something on the site infringes your rights, contact the campaign with the page address, a description of the material, your relationship to it, and a way to reach you. Do not include unnecessary sensitive information.

08

Links and outside services

External links can take you to donation services, social networks, official voter resources, and other independent websites. Their operators control their content, availability, security, and terms. Review those terms before using a feature or sending information.

A link does not make an outside service part of the campaign or guarantee its content. The campaign is responsible for its own conduct and for obligations that applicable law does not allow it to transfer or disclaim.

09

Accuracy and availability

We aim to keep campaign information accurate and the website usable, but pages and tools may contain mistakes, become outdated, or be temporarily unavailable. We may correct content, change features, or interrupt access for maintenance or security. Please report a broken tool or accessibility barrier through the campaign contact form.

Website information is general campaign information, not individualized legal, tax, financial, medical, or other professional advice. Statements about policy describe campaign positions, proposals, or documented work; they do not guarantee a future legislative or governmental outcome.

To the extent permitted by applicable law, the website is provided as available without a guarantee of uninterrupted access, error-free content, or fitness for a particular purpose. This provision does not override an express commitment in our Privacy policy or a legal duty the campaign must meet.

10

Responsibility and your rights

To the extent permitted by applicable law, the campaign is not responsible for indirect or consequential losses caused by a website interruption, an inaccurate informational tool, or an independent service outside its control. Responsibility for any claim remains subject to the facts and applicable law.

Nothing in these terms excludes liability that cannot lawfully be excluded, excuses fraud or intentional misconduct, or takes away a nonwaivable right. These terms do not require mandatory arbitration, waive class proceedings, or require you to indemnify the campaign for ordinary use of the website.

11

Applicable law and disputes

Missouri law and applicable federal law govern these terms, without displacing protections that legally apply to you and cannot be waived. A court with lawful jurisdiction may hear a dispute; these terms do not impose an exclusive distant forum.

If an issue arises, you may contact the campaign to seek a practical resolution. Doing so is not a prerequisite to exercising a legal right. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.

12

Changes and contact

The effective date at the top identifies this version. We may revise these terms as the site or applicable requirements change. Revisions apply prospectively, and any additional notice or agreement required by law will be provided. A new version does not rewrite the terms of a completed donation or create new consent for previously collected information.

Questions about these terms, access to the site, or a website concern can be sent through the Duncan for KC campaign contact form. Information about those messages is covered by our Privacy policy.
